IndeLearn Terms and Conditions

1. Introduction

Welcome to IndeLearn! These Terms and Conditions ("Terms") govern your access to and use of the IndeLearn platform ("Platform"), a SaaS solution that allows educators to create and manage online courses, provide video lectures, quizzes, and other educational content. By accessing or using the Platform, you agree to these Terms. If you do not agree, you may not use the Platform.

2. Definitions

• Platform: Refers to the IndeLearn website, applications, and services.
• Educator: An individual or organization using IndeLearn to provide courses and content to learners.
• Learner: Any individual who enrolls in or accesses content from an educator.
• User: Refers to both educators and learners who use the Platform.

3. Eligibility

You must be at least 18 years old or have the legal capacity to enter into a binding contract under Indian law. By using the Platform, you represent and warrant that you meet these requirements.

4. User Accounts

Account Creation: Users must create an account to access certain features of the Platform. All information provided during registration must be accurate and up-to-date.

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Account Termination: IndeLearn reserves the right to suspend or terminate any account that violates these Terms.

5. Services Provided

IndeLearn offers a platform for educators to host online courses, provide recorded and live lectures, and facilitate learner engagement through various educational tools, including quizzes ,virtual labs,recorded and live lectures along with course notes and submission. IndeLearn provides hosting, SSL, and deployment services for educators to create branded domains.

6. User Responsibilities

Educators: Educators are responsible for the content they upload and share on the Platform, including the accuracy, legality, and appropriateness of such content.

Learners: Learners agree to use the Platform only for personal, non-commercial learning purposes. Any misuse of content or services will result in immediate termination of access.

7. Fees and Payments

Platform Fees: IndeLearn charges a platform fee of 10% for every course sold by educators.

Payment Processing: IndeLearn offers payment integration services and may work with third-party payment processors. By using these services, you agree to comply with the terms set by those providers.

Refund Policy: IndeLearn does not directly offer refunds for courses. Once a course is brought by user the 10% fee cut will not be refunded

8. Intellectual Property

Platform Content: IndeLearn owns all rights, title, and interest in and to the Platform, including its design, functionality, and software.

User Content: Educators retain ownership of the content they upload but grant IndeLearn a non-exclusive, worldwide, royalty-free license to host, display, and distribute this content as part of the services provided.

Copyright Violations: IndeLearn respects intellectual property rights and will respond to claims of copyright infringement.

9. Privacy

IndeLearn is committed to protecting user privacy. Please refer to our Privacy Policy for details on how your data is collected, used, and protected in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

10. Security

IndeLearn implements a range of security measures to protect users' information and ensure privacy. However, no method of transmission over the internet is 100% secure, and IndeLearn cannot guarantee absolute security.

11. Limitation of Liability

To the maximum extent permitted by applicable law, IndeLearn will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to loss of data, revenue, or profit. IndeLearn’s liability is limited to the amount paid by you to IndeLearn in the 12 months preceding the event giving rise to the claim.

12. Termination

IndeLearn reserves the right to suspend or terminate access to the Platform for any reason, including breach of these Terms. Upon termination, users must cease using the Platform and may lose access to their accounts and content.

13. Modifications to Terms

IndeLearn reserves the right to update these Terms at any time. Changes will be effective upon posting the updated Terms on the Platform. Continued use of the Platform constitutes acceptance of any changes.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

• Educator Responsibilities:
• You must comply with all applicable child protection laws when creating content targeted at or accessible to minors (individuals under the age of 18).
• You are responsible for obtaining parental or guardian consent when collecting, storing, or using personal information of children as part of any educational activity.
• Any content shared with children must be age-appropriate and should not contain any inappropriate, harmful, or illegal material.
• You must protect the personal information of children in accordance with Indian child protection laws and must not share such information without proper consent.

IndeLearn Refunds and Cancellation Policy

At IndeLearn, we strive to provide a seamless learning experience. This Refunds and Cancellation Policy outlines the terms under which refunds and cancellations may be processed for courses and services provided through our platform. By enrolling in a course or using our services, you agree to the terms of this policy.

2. Course Cancellation Policy

No Cancellation Policy:

• Once a user purchases a course, the purchase is final and non-refundable. Users cannot cancel their enrollment or request a refund for any reason after the purchase is completed.
• Please note that a 10% platform fee will not be refunded in the event of a cancellation request.

3. Refund Policy

Eligibility for Refunds:

• Due to the no-cancellation policy, refunds will not be issued for course purchases, including the 10% platform fee.
